A federal bankruptcy court OK'd the sale in November. Broadway now operates the plant under a court-approved agreement between the town and DEQ, which the Waterkeeper Alliance and U.S. Environmental Protection Agency have criticized for being too lenient and endangering the river. In December, the Waterkeeper Alliance filed an intent to appeal the agreement because they said it violated the initial state DEQ permit. The group, in a letter from Gerlach dated Jan. 4, announced it was dropping its appeal. Gerlach said that decision was made because it "was a tough case to bring legally and would have gone through several rounds of appeals" that could have lasted several years. With federal lawsuits, the group may have a greater chance for "success," Gerlach said, because the case won't go before the same judge, and the litigation is more straightforward.

This scenario isn't just with Border Patrol many other dumb criminals have tried this tactic with CHP, LAPD, LASO, and just about every other law enforcement agency. It's been a while since I've posted. School, work, play - you know, general life stuff that tends to get in the way. But rest assured that I AM going to make a concentrated effort to update this thing more often because there are a lot of really great things going on. Like tonight: Daniel Johnston at Slowdown. It's gonna be real interesting, and good to boot. Eighteen bucks to see a legendary singer-songwriter. Plus, I haven't seen Flowers Forever yet, and I've heard mixed reviews...very anxious to decide for myself. On a very unrelated note, today I read an excellent article in the Jan. 28 New Yorker on the Obama/Clinton race. I'm not well versed in politics, and frankly, not terribly interested in them either. But this article made me think about the differences in ideology of the two candidates, which was really great.
